1. Introduction

We attach great importance to the secure, transparent and confidential collection and processing of your personal data. In particular, we want to protect the data of our customers, subcontractors and suppliers from loss, breach, error, unauthorised access or unauthorised processing. With this data protection notice, we want to inform you about the collection and processing of your personal data. We ask you to read this data protection notice carefully, as it contains important information about how and why we process your personal data. By submitting your personal data, you explicitly declare that you have read this data protection notice and that you explicitly accept its content and the processing itself. 

2. Scope of application

This data protection notice applies to all services provided by us and more generally to all activities carried out by us and our subsidiaries. 

3. Person responsible for the processing and its commitments

JAMAR SRL, whose registered office is located at Parc Créalys 5032 Isnes, and whose company number is BE 0401.400.945, is responsible for processing your personal data.

In collecting and processing your personal data, we comply with Belgian legislation on the protection of personal data, as well as with the General Data Protection Regulation (GDPR) from its entry into force on 25 May 2018. 

4. Personal data

Depending on your activities and the relationship with our company, you will provide us with the following personal data: your identity and contact data (name, title, address, e-mail address, telephone number, mobile phone). For certain special legal obligations (e.g. electronic attendance registration, 30bis declaration of works), you may have to provide us with additional data in order to register your attendance (such as E-ID data, Limosa number). Other personal data, such as your date of birth, bank account number, family composition, occupation, etc., may also have to be provided. We would like to point out that you are responsible for all the data you provide us with and we rely on their accuracy. If your data is no longer up to date, we ask you to inform us immediately. You are not obliged to provide your personal data, but understand that it will be impossible to offer certain services or to collaborate if you do not consent to the collection and processing of certain data.

5. The purposes of the processing and the legal basis

5.1. Customer data

Within the framework of our services and activities, we collect and process the identity and contact data of our clients and principals, their staff, employees, agents and any other relevant contact person. The purposes of this processing are the execution of agreements with our customers, customer management, accounting and direct marketing activities, such as sending promotional or commercial information. The legal bases are the performance of a contract, compliance with legal and regulatory obligations and/or our legitimate interest.

5.2. Data from suppliers and subcontractors

We collect and process the identity and contact data of our suppliers and subcontractors, as well as of their possible (sub)subcontractors, their staff, employees, agents and any other relevant contact person. The purposes of this processing are the execution of this agreement, the management of suppliers/subcontractors, accounting and direct marketing activities, such as sending promotional or commercial information. The legal bases are the execution of the contract, the fulfilment of legal and regulatory obligations (such as compulsory electronic attendance registration, declaration of works 30 bis, attendance list or other obligations in public procurement, etc.) and/or our legitimate interest. For the electronic registration of attendance, if applicable, the E-ID data or the Limosa number will be processed.

5.3. Personnel data

We process the personal data of our employees in the context of our personnel and payroll management. Due to its specific nature, this processing is addressed separately and in more detail in a Data Protection Policy for Employees. 

5.4. Other data

In addition to the data of customers, suppliers/subcontractors and staff, we also process the personal data of other persons, such as new customers/prospects, useful contacts within our sector, networking contacts, contacts of architects, engineers, experts, etc. The purposes of this processing are in the interest of our business, direct marketing and public relations. The legal basis is our legitimate interest or in some cases the execution of a contract.

6. Duration of treatment

Personal data is kept and processed by us for a period of time necessary for the purposes of the processing and the relationship (contractual or otherwise) between us. Data of customers and suppliers or subcontractors will, in any case, be removed from our systems after a period of eleven years after termination of the contract, or after the end of the project, except for personal data that we are obliged to keep for a longer period on the basis of specific legislation or in case of pending litigation for which the personal data is necessary.

7. Rights

In accordance with and under the conditions of the Belgian data protection legislation and the provisions of the General Data Protection Regulation, we inform you that you have the following rights:   

Right of access: you have the right to see, free of charge, the data we hold about you and to check what it is used for.

Right of rectification: you have the right to obtain rectification (correction) of incorrect personal data concerning you, as well as the right to complete incomplete personal data. 

Right to erasure or restriction of data : You have the right to ask us to erase your personal data and to restrict the processing of such data in the circumstances and under the conditions set out in the General Data Protection Regulation. However, we may refuse to erase or restrict data that is necessary for us, e.g. for the processing of wages, the fulfilment of a legal obligation, the performance of a contract or our legitimate interest, provided that such data is necessary for the purposes for which it was collected. 

Right to data portability: you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format. You have the right to transfer this data to another controller.

Right to object: you have the right to object to the processing of your personal data on serious and legitimate grounds. However, you cannot object to the processing of data that is necessary for the fulfilment of a legal obligation, the performance of a contract or our legitimate interest, provided that such data is necessary for the purposes for which it was collected.

Right to withdraw consent: If the processing of personal data is based on prior consent, you have the right to withdraw this consent. This personal data will then only be processed if we have another legal basis.

Automatic decisions and profiling: we confirm that the processing of personal data does not include profiling and that you will not be subject to fully automated decisions. You may exercise the above rights by sending a written request, together with proof of your identity, to our registered office or to the following e-mail address: "info@jamar.pro". We make every effort to ensure the careful and legitimate processing of your personal data in accordance with the applicable regulations. If, however, you feel that your rights have not been respected and you feel that your concerns are not being listened to within our company, you also have the right to appeal to the Commission for the Protection of Privacy, rue de la Presse 35, 1000 Brussels (e-mail: commission@privacycommission.be).   

8. Transfer of data to third parties

Certain personal data may be transferred to and processed by third parties in the context of services provided on our behalf and solely on the basis of our instructions, such as our IT and communication service providers, company secretariat, auditors, as well as by the government (e.g. in the case of the 30bis declaration of work, electronic attendance registration or for the award of public contracts). If one or more of the third parties is located outside the European Economic Area ("EEA"), personal data will only be transferred to third countries with an adequate level of protection. The employees, managers and/or representatives of the above-mentioned service providers or institutions, as well as the specialised service providers appointed by them, are obliged to respect the confidential nature of your personal data and may only use such data for the purposes for which it was provided.   

If necessary, personal data may be transferred to other third parties. This may only happen in the event of a partial or complete reorganisation of the company, if our activities are transferred or if we are declared bankrupt. It is also possible that personal data may have to be transferred due to a court order or in order to fulfil a particular legal obligation. In this case, we will make every effort to inform you in advance of such disclosure to other third parties. You acknowledge and understand, however, that in some circumstances this may not be technically or commercially feasible, or that legal limitations may apply. We will not sell your personal data under any circumstances, nor will we make it available to direct marketing agencies or similar service providers without your prior consent.

9. Technical and organisational measures

Your personal data will be treated confidentially. We make every effort to take the necessary technical and organisational measures to ensure the security of your personal data. However, under no circumstances can we be held liable for any direct or indirect damage caused by the incorrect or unlawful use of personal data by a third party. 

10. Access by third parties

For the purpose of processing your personal data, we allow access to your personal data to our employees, collaborators and agents to whom we impose the obligations described in this notice.
